Welcome to the website of Sikadan Homes (“we”, “us”, “our”). By accessing or using this website and/or any service offered via this website (including our SmartRent rent-monthly product, SmartBuild building services, property management service for landlords) you agree to these Terms & Conditions (the “Terms”). If you do not agree, please do not use the website or our services.

2. Definitions

• User: any person who uses our website and/or engages with our services (whether as a tenant, landlord, builder, or otherwise).
• Tenant: a User who subscribes to rent accommodation via our SmartRent service.
• Landlord: a User who owns rental property and uses our property-management service.
• SmartRent: our product that allows tenants to rent monthly, interest-free, with no hidden fees.
• SmartBuild: our building/ construction/ development service offered by us.
• Property Management Service: our service to landlords (tenant screening, tenancy agreements, maintenance, rent collection).
• Website: the website at www.sikadanhomes.org and its associated pages.
• Service(s): any of the services we provide via the Website, including SmartRent, SmartBuild, Property Management Service and any other that we may from time to time offer.

3. Using Our Services

• You represent and warrant that you are at least 18 years old and have full legal capacity to enter into these Terms.
• You agree to use our Services only for lawful purposes and in compliance with these Terms and all applicable laws, including Ghanaian law.
• We may require you to register for an account or provide certain information to access parts of the Services. You agree to provide true, accurate, current and complete information and maintain and promptly update it as necessary.

4. SmartRent (Tenants)

• The SmartRent service allows tenants to rent accommodation on a monthly basis, without interest, and with no hidden fees. (As per website statement: “Live Smart & Pay Rent Monthly, Forever. Enjoy flexible, interest-free rent payments with no hidden fees.”) Sikadan Homes
• By agreeing to use SmartRent you accept that:
  • You will pay rent monthly as agreed in the tenancy agreement.
  • Failure to pay may result in late fees, termination of tenancy, or other consequences as set out in the tenancy agreement.
  • We are not providing a loan; this is a rent payment arrangement.
• We reserve the right to modify or discontinue the SmartRent service at any time (with or without notice) but we will endeavour to provide reasonable notice when feasible.

5. Property Management Service (Landlords)

• For landlords, our service includes tenant screening, tenancy agreements, maintenance and rent collection at no cost to you (as per our website). Sikadan Homes
• You agree that we may act in your name or on your behalf for certain services (as specified in our separate agreement) but only to the extent permitted by law.
• You are responsible for ensuring the property is compliant with all applicable laws, regulations and safety standards.

6. SmartBuild & Other Services

• Any building, construction or development services we provide will be subject to a separate contract that sets out scope, timelines, payment, warranties and any other terms.
• Unless otherwise agreed in writing, these Terms govern your use of the Website; the service-specific contract governs the specific service.

7. Payment and Fees

• For tenants: The amount and timing of monthly rent will be set out in your tenancy agreement.
• For landlords or SmartBuild clients: fees, billing, payment terms will be specified in your separate agreement with us.
• Where we need to process payments, you agree to provide accurate payment and billing information and to authorise us (or our payment processor) to charge you accordingly.

8. Intellectual Property & Website Use

• All content on the Website (text, images, logos, trademarks, design) is our property or licensed to us. You may not reproduce, distribute or create derivative works without our prior written consent.
• You may use the Website for your personal, non-commercial use only (unless otherwise agreed).
• You shall not use the Website in any way that:
  • violates any applicable law or regulation;
  • infringes any third-party rights;
  • is harmful, fraudulent, deceptive, malicious or otherwise objectionable;
  • interferes with the Website or its infrastructure.

9. Disclaimers & Limitation of Liability

• We provide the Website and Services on an “as-is” and “as-available” basis, to the fullest extent permitted by law.
• To the extent permitted by applicable law, we disclaim all warranties, express or implied (including fitness for a particular purpose, non-infringement).

  • any acts or omissions of third parties (including landlords, tenants, property owners) outside our direct control.
• Our aggregate liability for direct losses under or in connection with the Website or Services shall not exceed the total amount paid by you to us in the 12 months preceding the event giving rise to liability (or, if no payments have been made, GHS [insert amount]).

10. Termination & Suspension

• We may suspend or terminate your access to the Website and/or Services at our discretion (for example, for violation of these Terms, non-payment, fraud) with or without notice.
• Upon termination, you must cease all use of the Website and return or destroy any materials as required.
• Termination does not relieve you of any payment obligations incurred prior to termination.

11. Governing Law & Jurisdiction

• These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana.
• Any dispute, controversy or claim arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ghana.

12. Changes to the Terms

• We may modify these Terms at any time. We will post the revised Terms on the Website and update the “Last updated” date.
• By continuing to use the Website or Services after such changes you accept the revised Terms.
